The motion to dismiss filed by Joe Brazil against Jeff Roe was denied today. Brazil originally filed a lawsuit against Roe for libel regarding false allegations Roe posted on his web site, The Source, about a tragic accident that occurred back in 1982. Roe then filed a counter claim against Brazil apparently claiming Brazil was the source of information for a column which appeared in the First Capitol News calling Roe "a political assassin." Roe has also sued First Capitol.
In ruling on Brazil's motion to dismiss the issue is simply whether a cause of action is stated. The court is required to assume Roe's allegations in the lawsuit are true and then determine if these allegations would be grounds for a lawsuit. Roe's lawsuit could still be dismissed at a later date by the court or all of the cases could proceed to trial. This ruling has no effect on Brazil's lawsuit against Roe.

The State Senate race will finally come to a head as well. County Councilman Joe Brazil, who turned out to be all talk, has not really mounted much of a challenge against incumbent Scott Rupp. Notwithstanding his RINO status, Brazil really hasn’t capitalized on his Democratic base to help him and his RINO supporters, MacNab and Pedersen, are actually terrible campaign staff. I think he will receive the trouncing he richly deserves and maybe the smart growth whackos will go find another county to bother.
Councilman Joe Brazil is likely the most athletic of the remaining council members. But based on the way he behaves on the Council, he would probably be a “ball hog” (i.e., he’d steal the ball from his own teammates). So, I would suggest using Councilman Bob Schnur or Doug Funderburk instead; they would be better “team players.”
A little bit closer to home and a little bit down ticket, the Rupp-Henke re-match is certainly becoming heated. It is worth noting that this is a “re-election” battle for Senator Rupp. Yet again, most of Rupp’s trouble is coming from within the party. You’ve still got RINO and sore loser Joe Brazil and his merry band of idiots complaining about the race.
The trouncing that Scott Rupp gave Joe Brazil was pretty impressive. I can’t honestly say that I was surprised, as I suspected that Rupp would carry the day. The surprise comes from the losing camp. I can’t believe what a sore loser Brazil is. I mean, what’s up with this guy? He has whined to anyone who will listen that he was somehow persecuted by the Republican Party.
